Overview
This Privacy Notice applies to the current and prospective independent contractor Spark Driver™ program participants (“you”). It covers the personal information that Wal-Mart Canada Corp. (“Walmart”, “we” or “us”) may collect, disclose, use, or otherwise process (“process”) from you through your use of this Website, the Spark Driver App, and any other interactions with the Spark Driver Program (collectively, the “Spark Driver Program”). Under Canadian privacy laws “personal information” means any information that can identify you directly or indirectly.
The following is a high-level summary of this Privacy Notice. Please read the Privacy Notice fully to understand how Walmart may Process your Personal Information through your participation in the Spark Driver Program:
- Accountable: Walmart, with offices at 1940 Argentia Road, Mississauga, Ontario L5N 1P9, is the accountable organization for all personal information that you share with us.
- CECO: To help meet our commitment to you, we have appointed a Chief Ethics and Compliance Officer ("CECO") to oversee our privacy practices and privacy compliance program. - Information Collection: When you interact with Walmart, we process personal information to enable your participation in the Spark Driver Program, among others, as set out in this Privacy Notice.
- Information Use: We use personal information to enable your participation in the Spark Driver Program, among others, as set out in this Privacy Notice.
- Information Sharing: We share the personal information we process in a number of different circumstances, including to our service providers and other third parties who assist us in providing Spark Driver Program services to you. Some of the third parties we share your personal information with may be located outside of Canada.
- Data Processing Location: Your personal information may be stored within Quebec, outside of Quebec at our data processing locations within Canada, and/or across international borders for processing by other Walmart affiliates, Walmart Inc. or third-party data processors performing support functions on our behalf in countries and jurisdictions for us to provide Spark Driver Program to you. Such data transfers occur in accordance with applicable law.
- Security: We are committed to safeguarding your personal information. We implement robust security measures and follow applicable privacy laws to protect your data from unauthorized access, use, or disclosure.

What Personal Information Do We Process?
When you interact with Walmart, we may process the following personal information without limitation:
- Basic Personal Identifiers: such as name, telephone number, physical address, email address.
- Identity related Information: such as government-issued identifiers (e.g. driver’s license and information contained within a driver’s license, and other tax identifiers), and signatures.
- Financial Information: such as information about your bank routing and account numbers, tax information, and other earnings and payment information (e.g., digital wallet information).
- Driver Information: such as driving records, vehicle information, vehicle insurance information, business name, number, and GST/HST number.
- Background Information: such as background checks, including criminal convictions, driving history, authorization to work in Canada, and screening against applicable watchlists, and restricted party lists, which may be conducted on an ongoing basis.
- Device and Usage Information: for any devices you use associated with the Spark Driver program, we may process without limitation:
- Device identifiers, and other online identifiers, such as account login information, MAC address, IP address, cookie IDs, mobile ad IDs, operating system version, phone carrier and manufacturer, phone line type, application installations, and push notification tokens.
- Internet, Network Activity Information, and Other Device and App Usage Information, such as information about your interactions with our Website or the Spark Driver App, including the pages or other content you view while the Spark Driver App is open or while on our Website, the actions you take on our Website or within the Spark Driver App itself, and the dates and times you visited our Website or opened the Spark Driver App.
- Geolocation: such as data about the location of your device, including precise geolocation for your participation in the Spark Driver Program.
- Claims Information: such as personal information processed when an accident, injury, or other claim relating to your provision of Services (as defined in the Spark Driver Terms of Use) is reported. Walmart may investigate and process additional information regarding the claim as determined in Walmart’s discretion.
- Biometric Information: such as face geometry: Biometric information is collected with your consent by technology providers and/or vendors for business operations processing the data on our behalf. See Who Do We Disclose Your Personal Information to and Why? for more information.
- Sensory Information: such as information from camera and microphone access (e.g., audio and video recordings, ambient light sensor information), and device movement (such as device orientation and acceleration).
- Demographic Information: such as age, gender, language, and date of birth.
- Communications: such as the content of emails, text messages, social media posts or messages, or other communications, call logs, and surveys, where Walmart is a party to the exchange, or where you use chat features Walmart provides.
- Content and Files and Other Photographs and Videos: such as photos or files you upload in the Spark Driver App or send via any communication with us. If you choose to participate in surveys, focus groups, or other voluntary research, we may photograph or make video and audio recordings as part of those voluntary research efforts.
We use information above that may be considered Sensitive Personal Information. Where required by law, Walmart only processes this Sensitive Personal Information with your consent. Sensitive Personal Information includes precise geolocation and biometric information and may include some sensory information, government identifiers (such as driver’s license), financial account information, background information, and any communications where Walmart is not a party.
How Do We Process This Personal Information?
We may lawfully obtain and combine personal information from different sources, types of technology, and devices, including:
- Provided directly by you.
- Collected from a device associated with you.
- Collected through in-store technology.
- Collected from another company within our family of companies.
- Collected from an external third-party source for the purposes of Walmart enabling your participation in the Spark Driver Program (e.g. payment process provider).
- Collected from other sources, when it is appropriate.
How Do We Use Personal Information?
We use your personal information to maintain your account and enable your participation in the Spark Driver Program, to provide you with services within the Spark Driver Program and use of the Spark Driver App and to operate and improve our business. For example, without limitation, we use it for:
- Performing and marketing services, including maintaining, servicing, improving, and promoting the Spark Driver Program, including the Spark Driver App and your driver account; displaying Service Offers; translating communications into a preferred language; providing customer service and driver support; verifying driving information; processing payments and earnings; notifying you about Services demand and compensation; providing similar services or communications; operating incentive and rewards programs; and/or communicating order and delivery status to customers.
- Fulfilling requests and obligations related to our partnership, including displaying relevant information about you to Receiving Parties (as defined in the Spark Driver App Terms of Use) receiving Services from you, or updating you on the status of your registration.
- Conducting auditing and monitoring of the Spark Driver Program.
- Protecting the security and integrity of our websites, mobile services, and our business. This may also include responding to trust and safety issues that may arise, such as auto incidents, injury claims, disputes regarding deliveries, and requests from government authorities.
- Improving the Spark Driver App and Spark Driver Program. This may include efforts to improve the efficiency of operations and the features available or offered to you in relation to the Spark Driver Program.
- Helping to detect and prevent fraud and enforce our terms.
- Updating our operational and technical functionality.
- Debugging to identify and repair errors.
- Conducting business analysis, such as analytics, projections, identifying areas for operational improvement, including analyzing how the driver community uses the Spark Driver App.
- Conducting research, development, and training opportunities.
- Fulfilling our legal functions or obligations, including establishing and defending legal claims.
Who Do We Disclose Your Personal Information to and Why?
When permitted by law, we may share your personal information with third parties, under the following limited circumstances:
To Customers: We may disclose your name to customers to facilitate secure delivery of their orders or address claims related to their order delivery. We may also disclose Claims Information and related personal information to customers in the event of claim. If a customer signs up for delivery updates, we may also communicate the estimated delivery time and the location of their delivery. Additionally, Walmart customers will receive the communications you send via our “contact customer” features.
To Other Companies: We may disclose personal information to the entities listed below. When we do, the information will be used in ways that are consistent with this Privacy Notice.
To Service Providers: We may share your personal information with service providers that help with our business activities. We do not allow our service providers to use or share your personal information for any purpose other than providing services on our behalf. Your personal information may be stored and processed by our service providers in Canada, the United States or other locations where the service providers or Walmart maintain facilities. These service providers may include:
- Payment facilitation services.
- Companies that help us operate and improve our products and services.
- Companies that manage insurance claims, comply with our legal obligations, or provide other administrative services.
- Insurance Providers: If the information is relevant to a claim of personal injury or property damage involving you, the Spark Driver Program may share some limited information with an insurance provider. The person who submitted the insurance claim or their representatives may receive some limited information about the driver through the insurance claim.
- Identity verification vendors , which process personal information including biometric information, such as facial geometry, and government identifiers to verify identities and help us prevent fraud and safeguard the Spark Driver Program and to comply with our legal functions or obligations.
Legal: Walmart and its service providers and affiliates may disclose your personal information in response to a request pursuant to applicable law or governmental authority.
Business Transfers: In the event that all or a part of our business is merged, sold or reorganized (including transfers made as a part of insolvency or bankruptcy proceedings), personal information about you could be shared with the successor business.
With Specific Notice or Your Consent: In circumstances other than those described above, we will provide specific notice or ask for your consent, as required by law, before we share your personal information outside of our corporate family of companies, and we also will not sell or rent your personal information for money.

How Long Do We Retain Your Personal Information?
We keep your personal information for only as long as it is required for the purposes for which it was collected, or as otherwise permitted by applicable law, after which we delete or anonymize your personal information.

Walmart is committed to keeping your personal information secure. Walmart has a range of privacy and security controls across the organization to ensure compliance with the applicable privacy laws, including but not limited to:
- A privacy impact assessment driven process to ensure that all products and services are built with a focus on privacy by design and by default
- An extensive, on-going training program for its associates, with privacy and information security training upon hiring and then again at least on an annual basis
- State-of-the-art technical and security measures, including data encryption at rest and in transit
- Data maps and records of processing which document the purpose and details of personal information storage and transfer throughout Walmart networks and to third party data processors
- Appropriate access right limitations
- Centralized systems for consent and data subject right management, ensuring that individual access/portability/right-to-be-forgotten and consent permissions are respected and
- Appointment of a Person in Charge of privacy as well as set up of a Privacy Office.

How Does Spark Driver Protect the Privacy of Children Online?
Spark Driver™ App Services is a general audience website intended for business-to-business use and not directed at children under the age of 13.

We will provide notice of significant updates, but please check our Privacy Notice periodically for changes. We will always post the date our Privacy Notice was last updated at the top of the Notice.

In order to access, delete or update/correct your personal information, please submit a written request by email to CAPrivacy@wal-mart.com. The request should be titled “Spark Driver DSR Request”.
